Terms of Service
The artist (Traci Lei Artistry LLC) has the right to refuse any commission [the form of service, artwork, project, image] request without needing to explain the reason.
The artist reserves the right to stop work on and/or cancel a commission request due to poor and/or unclear communication, inappropriate behavior, medical emergency, or a breach of the Terms of Service.
The artist will not reproduce unoriginal, copied, or copyrighted images without consent of the image owner.
The artist will not accept commissions with a strict and/or short deadline.
By commissioning the artist, the client [individual or entity requesting and/or purchasing the commission] is purchasing the artist’s labor only. The artist retains all rights to the commission, which includes but is not limited to: reproduction and use of the commission image for promotion and display on social media and public space; reproduction and use of the commission image for art competitions.
The client may not distribute, reproduce, or otherwise profit from the commission beyond the resale of the original.
The client may not edit, alter, or trace the commission, or license or sell the commission in any way as a non-fungible token, without the artist’s written permission, or as agreed upon in the commission agreement*.
The client may display the commission in social media that does not display hateful or racist imagery, illegal activities, or locations or organizations known to display, reproduce, and/or sell works as long as the artist’s name (“Traci Lei Artistry”) is prominently displayed along with a link to https://www.tracileiartistry.com. Additionally, any social media display of the artist’s commission must notify or “tag” the artist.
The client must obtain written permission from the artist prior to displaying the commission in a public space; additional fees may apply.
Under no circumstances may the client submit a commission to any kind of contest.
The client may not incorporate the commission in another work of art.
No refunds will be issued after start of work (artist has begun to create the commission following a signed Commission Agreement), nor will a refund be issued before or after start of work if any Terms of Service are breached.
The artist has the right to pursue damages under United States Copyright Law, should there exist a copyright violation in addition to a breach of these Terms of Service.
*Commission Agreement: A signed agreement between the artist and client that documents commission details such as: subject matter, size and medium, price quote for the start of work and price quote for final payment, payment method, estimated schedule, completion definition/agreement and any Terms of Service developed in addition to those herein. The Commission Agreement is subject to revision by the artist or client until signed by both parties. Upon signature the Commission Agreement is a binding contract. This contract can be adjusted by the artist or client after execution if both parties agree to replace the Commission Agreement with an Adjusted Commission Agreement and document all adjustments to the original Commission Agreement. The Commission Agreement and any applicable Adjusted Commission Agreements shall remain on record with the artist, along with any other documents related to the commission, for at least two years.
